Litigate won his career debut in his only start as a 2-year-old, taking a 6 1/2-furlong maiden race at Aqueduct on Nov. 10, 2022. His next start was his 3-year-old debut which came in a one-mile allowance race at Gulfstream Park on Jan. 8, 2023. He won a battle for second behind that day's runaway winner, Cyclone Mischief.

Litigate subsequently was sent to Tampa Bay Downs for his third career outing, which was his stakes debut in the $250,000 Grade 3 Sam F. Davis Stakes on Feb. 11. Sent off as the second choice on the tote board at 2.8--1 odds in a field of 11, Litigate stalked the pace in mid-pack and challenged for the lead in the stretch before earning the win by 1 1/4 lengths in a time of 1:44.83 for the 1 1/16 miles. The Sam F. Davis was a points race on the Road to the 2023 Kentucky Derby. With his victory, Litigate earned 20 points.
